TERMS AND CONDITIONS OF CARRIAGE


1. SERVICES

CE Beaufort agrees to provide shipping (sea and air freight), overnight and Same Day transportation, courier and logistics & distribution services to the customer in accordance with the terms and conditions set out in these Terms and Conditions and those contained in the Bill of Lading, and in accordance with CE Beaufort specified rates. Any reference to "Bill of Lading" in these Terms and Conditions includes any shipping document, Sea Freight Bills of Lading, Air Way Bills, label, waybill, manifest or similar item used by CE Beaufort in the provision of its Sea freight, Air Freight, Land transportation, courier and distribution services.


2. PAYMENT

Non-contract customers shall pay for transportation, courier and distribution services within seven (7) days from the date of invoice. Contract customers shall pay for transportation, courier and distribution services within fourteen (14) days from the date of invoice, in accordance with their Volume Discount Program Agreements, or any other transportation, courier and distribution services agreement. In the event the customer fails to pay an invoice in full, when due, interest calculated at the rate of 1.5% per month (with an effective rate of 19.6% per annum) shall accrue and be payable to CE Beaufort, on all outstanding amounts. This is in addition to any legal rights and remedies available to CE Beaufort.


3. NOTICE OF CLAIM FOR LOSS, DAMAGE OR DELAY


(3.1) Loss, Damage or Delay's and/or Claims.


CE Beaufort is not liable for loss, damage or delay to any goods carried pursuant to the Bill of Lading unless, in the case of domestic shipments and other shipments where the Convention (as defined under Applicable Law) does not apply, notice thereof setting out particulars of the origin, destination and date of shipment of the goods and the estimated amount claimed in respect of such loss, damage or delay is given in writing to CE Beaufort within sixty (60) days after delivery of the goods, or, in the case of failure to make delivery, within nine (9) months from the date of shipment. The final statement of claim must be filed within nine (9) months from the date of shipment together with a copy of the paid Bill of Lading. In the case of shipments where the Convention (as defined under Applicable Law) applies, written claims for damage of or to the shipment must be received by CE Beaufort within fourteen (14) days from the date of receipt of the shipment; for damages or losses of any kind resulting from delay, within twenty-one (21) days from the date of receipt of the shipment; and for damages or losses of any kind due to non-delivery or misdelivery, within ninety (90) days after acceptance of the shipment for carriage, failing which no action will lie against CE Beaufort. The right to damages of any kind against CE Beaufort shall be extinguished unless an action is brought within two (2) years from the date on which the shipment should have been delivered, or from the date on which carriage stopped.

When a claim is being made for concealed damage, the customer must notify CE Beaufort in writing within twenty-one (21) days from the time in which the goods were delivered. Excluding claims made in respect of Guaranteed Services, all claims are to be submitted in writing to:

(3.2) Notice of Claim for Guaranteed Services.


To obtain a refund or credit for transportation charges, where applicable, customers should call the telephone number on their invoices or 1 905-301-9401 (see Guaranted Services.). Note: Claims on guaranteed services are subject to written and agreed refunds offered prior to accepting shipments for carriage. Guaranteed services are not offered for sea freight and airfreight shipments.


4. DELAY

CE Beaufort is not responsible for the consequences of failure to deliver a shipment by a stipulated time due to �force majeure� and unforeseen circumstance beyond the control of the company and its employee�s diligent efforts.


5. MAXIMUM LIABILITY


IF NOT GOVERNED BY THE CONVENTION (AS DEFINED UNDER APPLICABLE LAW), THE AMOUNT OF ANY LOSS OR DAMAGE FOR WHICH CE BEAUFORT MAY BE LIABLE, WHETHER OR NOT THE LOSS OR DAMAGE RESULTS FROM GROSS NEGLIGENCE, SHALL NOT EXCEED CDN $4.41 PER KILOGRAM (OR CDN $2.00 PER POUND) COMPUTED ON THE TOTAL WEIGHT OF THE SHIPMENT, UNLESS A HIGHER VALUE (FOR CE BEAUFORT LIABILITY PURPOSES) IS DECLARED IN THE APPROPRIATE BOX ON THE FACE OF THE BILL OF LADING, OR, IN THE CASE OF SHIPMENTS TENDERED VIA CE BEAUFORT'S AUTOMATED SHIPPING SOFTWARE OR CE BEAUFORT ONLINE SHIPPING, IN THE SPECIALLY MARKED USER ENTRY FIELD, "DECLARED VALUE FOR INSURANCE($)", BUT IN NO EVENT SHALL SUCH A DECLARED VALUE EXCEED:


(5.1) FOR ALL SHIPMENTS (EXCLUDING SAME DAY SHIPMENTS) WITHIN CANADA OR FROM CANADA TO THE UNITED STATES, SHIPMENTS FROM THE UNITED STATES TO CANADA, AND SHIPMENTS FROM CANADA TO INTERNATIONAL DESTINATIONS OTHER THAN THE UNITED STATES, FIVE THOUSAND DOLLARS CANADIAN (CDN $5,000.00), PREPAID ONLY.

(5.2) FOR SAME DAY SHIPMENTS WITHIN CANADA, OR FROM CANADA TO THE UNITED STATES, FIVE THOUSAND DOLLARS CANADIAN (CDN $5,000.00), COLLECT OR PREPAID.

THE CUSTOMER AGREES AS A SPECIAL AGREEMENT WITH RESPECT TO ALL SHIPMENTS, REGARDLESS OF WHETHER OR NOT THE CONVENTION (AS DEFINED UNDER APPLICABLE LAW) APPLIES TO THE SHIPMENT, AND NOTWITHSTANDING ANY DISCLOSURE OF THE NATURE OR VALUE OF THE GOODS, THE AMOUNT OF ANY LOSS OR DAMAGE, INCLUDING, WITHOUT LIMITATION, LOSS OF EARNINGS OR PROFITS, RESULTING IN ANY MANNER, WHETHER OR NOT FROM NEGLIGENCE OR GROSS NEGLIGENCE, FROM LOSS OF OR DAMAGE TO THE GOODS AND/OR MISDELIVERY, FAILURE TO DELIVER OR DELAY IN DELIVERY OF THE GOODS, FOR WHICH CE BEAUFORT MAY BE LIABLE TO THE CUSTOMER/ SHIPPER, OWNER, RECEIVER AND/OR ANY THIRD PARTY WHETHER IN CONTRACT, TORT OR OTHERWISE, SHALL IN NO EVENT EXCEED THE MAXIMUM LIABILITY OF CE BEAUFORT SET OUT ABOVE. UNDER NO CIRCUMSTANCES SHALL CE BEAUFORT BE LIABLE FOR CONSEQUENTIAL, INCIDENTAL OR INDIRECT DAMAGES.

(5.3) SEA CARGO CLAIMS AND LIABILITIES WILL BE GOVERNED BY LAW AND REGUALATIONS, LIMITATION OF LIABILITIES AS MENTION ON THE REVERSE OF THE RESPECTIVE BILLS OF LADING OF ANY SEA FREIGHT SHIPMENT - CARRIAGE OF GOODS BY SEA. VIZ., YORK ANTWERP RULES, HAMBURG RULES, HARTER ACT, HAGUE VISBY RULES, ARBITRATATION AT, PROPER LAW, GENERAL AVARAGE RULES, ETC.,

(5.4)  INTERNATIONAL AND DOMESTIC AIR CARGO CALIMS AND LIABILITIES WILL BE GOVERNED BY LAWS AND REGUALTIONS STIPULATED ON THE REVERSE OF EACH RESPECTIVE AIR WAY BILLS/ WAY BILLS/ HAWB'S AND THE RESPECTIVE CARRIER�S LIMITATION OF LIABILITIES RULES FOR CARRIAGE OF GOODS BY AIR.


6. EVENTS BEYOND CE BEAUFORT�S CONTROL


CE Beaufort shall not be liable to refund or credit transportation charges or for damages, loss, delay, shortage, misdelivery, non-delivery, misinformation or failure to provide information in connection with any shipment (including both guaranteed and non-guaranteed services) caused by events beyond CE Beaufort's control, including but not limited to, any act, default or omission of the shipper, owner, receiver or any party having an interest in the shipment, defects or inherent vice in the shipment, inadequate or incorrect marking or address, acts of God, perils of the air, weather conditions, mechanical delays, disruptions in air or ground transportation networks, acts of public enemies, quarantine, war, strikes or other labour disruptions, riots or civil commotion, acts of public authorities (including customs or health officials) with actual or apparent authority or shipments requiring specialized handling, documentation or routing.

When a claim is being made for concealed damage, the customer must notify CE Beaufort in writing within twenty-one (21) days from the time in which the goods were delivered.

SHIPMENT AND PACKAGING


1. RIGHT OF INSPECTION

CE Beaufort reserves the right to open and inspect any package tendered to it for transportation.


2. REFUSAL OF PACKAGES

CE Beaufort reserves the right to refuse any package which, by reason of the dangerous character of its contents (or any other attribute), is liable, in the sole and unfettered judgement of CE Beaufort, to soil, taint, or otherwise damage other merchandise or equipment, or which is economically or operationally impractical to transport, or which is improperly packed or wrapped.


3. WEIGHT LIMITATIONS (Express Door Delivery)

CE Beaufort will accept shipments without maximum shipment weight limitations, provided no single piece or package exceeds 70 pounds, with the exception that single pieces may weigh up to 150 pounds, provided that Heavy Weight Service has been pre-arranged. (Please Note: Special Handling Charges may apply over 71 pounds.


4. SHIPPING RESTRICTIONS


(4.1) CE Beaufort does not accept C.O.D. shipments
(4.2) CE Beaufort does not provide service to post office boxes.
(4.3) CE Beaufort will accept certain Dangerous Goods provided they comply with all applicable legislation, including without limitation, the Transportation of Dangerous Goods Act, the Regulations thereto, the International Civil Aviation Organization(ICAO) Technical Instructions and the International Air Transport Association (IATA) Regulations.
(4.4) Glass and ceramics are not compatible with CE Beaufort's high speed sorting and handling process. Any shipments accepted into CE Beaufort's distribution system that contain glass or ceramics must travel at Shipper's Risk at shippers risk.
(4.5) CE Beaufort does not accept any shipment prohibited by law.
(4.6) CE Beaufort does not provide temperature controlled services. Any shipments requiring temperature control that are accepted into the CE Beaufort distribution system must travel at Shipper's Risk at Shipper�s Risk.
(4.7) CE Beaufort will only accept packages shipped in compliance with its Package Acceptance Policy.


5. ALTERNATE MODES OF TRANSPORTATION

CE Beaufort reserves the right to substitute alternate modes of transportation for that selected by the customer. Notwithstanding the foregoing, in the event the customer fails to indicate a mode of transportation on the Bill of Lading, CE Beaufort reserves the right to transport the shipment by the fastest mode of transportation available and customer acknowledges that charges based on such mode of transportation shall be levied and agrees to pay same. Any exercise by CE Beaufort of these rights shall in no way affect the maximum liability of CE Beaufort as indicated in these Terms and Conditions.


6. NON-COURIER CARRIERS

CE Beaufort reserves the right to substitute non-courier carriers for the purpose of completing delivery of any shipment to a destination point that is deemed by CE Beaufort to be remote or is not serviced directly by CE Beaufort. Any exercise by CE Beaufort of this right shall in no way affect the maximum liability of CE Beaufort as indicated in these Terms and Conditions.


7. PROHIBITED SHIPMENTS - DOMESTIC DESTINATIONS

The following items will not be accepted by CE Beaufort for shipment within Canada:

(7.1) Human remains in any form.
(7.2) Live animals, birds and insects.
(7.3) Live plants and cut flowers.
(7.4) Cash, bonds, stocks or other negotiable securities.
(7.5) Fish, seafood, meat and poultry (fresh or frozen).
(7.6) Items longer than 8 feet for AIR shipments and 10 feet for GROUND shipments.
(7.7) Tobacco or alcohol shipments, extraprovincial (i.e. between provinces).
(7.8) Dangerous Goods included in the following classes and/or divisions: Class 1 (except Class 1.4S); Class 2.3; Class 4.3, Packing Group 1; Class 5.2; and Regulated Wastes.


Note: For shipments outside of these guidelines, customers must contact their local sales professional or international Customer Service agent at 1-905-301-9401 to confirm if special handling procedures can be arranged and to inquire about applicable rates.


8. PROHIBITED SHIPMENTS - US DESTINATIONS

The following items, in addition to those listed above under the heading Prohibited Shipments-Domestic Destinations, will not be accepted for shipping to, from or within the United States (US):

(8.1) The following articles when shipped as personal effects or otherwise:

(8.1.1) Coins of any kind
(8.1.2) Cuban cigars
(8.1.3) Drugs prohibited by law, including aspirin containing codeine
(8.1.4) Furs, fur clothing, fur-trimmed clothing
(8.1.5) Jewelry, gold or any other precious metals (other than costume jewelry).


(8.2) Dangerous Goods included in any of the following classes and/or divisions: Class 1; Class 2.3; Class 4 (any division); Class 5 (any division); Regulated Wastes and any Dangerous Goods which are not prepared in accordance with the ICAO Technical Instructions/IATA Regulations.
(8.3) Shipments of alcohol, including samples.
(8.4) Weapons (and parts thereof) and ammunition.


9. PROHIBITED SHIPMENTS - INTERNATIONAL DESTINATIONS OTHER THAN THE USA

10. "AT SHIPPER'S RISK"

The following shipments are not well suited to CE Beaufort's distribution system and are subject to a high risk of damage. For these reasons, these shipments will be accepted for carriage, but only at shipper's risk (i.e. CE Beaufort shall not be liable and will not accept claims for any loss that may be sustained due to the loss, damage or delay in the shipment):

(10.1) Glass and ceramics.
(10.2) Liquids.
(10.3) Items requiring temperature control.
(10.4) Confectionery products, such as potato chips in any form, chocolate in any form, pastries and baked goods in any form.
(10.5) Household goods (i.e. privately packaged personal items).
(10.6) Electronic goods not packaged in accordance with CE Beaufort's Package Acceptance Policy.
(10.7) Those items that are prohibited but which are tendered to CE Beaufort and accepted for carriage.


"At shipper's risk" shipments accepted into CE Beaufort's distribution system must travel on a "no-value" basis (i.e. the maximum liability of CE Beaufort outlined under Maximum Liability can not be increased by the customer, including instances where a higher value (for CE Beaufort liability purposes) is declared in the appropriate box on the face of the Bill of Lading, or, in the case of shipments tendered via CE Beaufort's Automated Shipping Software or CE Beaufort Online Shipping, in the specially marked user entry fields "Declared Value for Insurance ($)" or "Declared Value for Carriage($)").


11. APPLICABLE LAW

The contract for the carriage of goods contained in the Bill of Lading shall be deemed to include and be subject to the terms and conditions prescribed by law of the jurisdiction where the goods originate, which are if Newfoundland and Saskatchewan, the Motor Carrier Act of each such province; Nova Scotia, British Columbia and New Brunswick, the Motor Vehicle Act of each such province; Prince Edward Island, the Highway Traffic Act; Quebec, the Transport Act; Ontario, the Truck Transportation Act; Manitoba, The Highway Traffic Act; Alberta and the Yukon, the Motor Transport Act for such province and Territory; Nunavut and the Northwest Territories, the Motor Vehicles Act for each such Territory; and any regulations to each of the above mentioned Acts.

When used in these Terms and Conditions, "Convention" means the Convention for the Unification of Certain Rules relating to International Carriage by Air signed at Warsaw, Poland, October 12, 1929 or that Convention as amended by the Hague Protocol 1955, the Montreal Protocol No. 4 and/or the Convention Supplementary to the Warsaw Convention for the Unification of Certain Rules Relating to International Carriage by Air Performed by a Person Other then the Contracting Carrier, which may apply to the carriage of international shipments and, in most cases, will limit the liability of CE Beaufort in respect of loss or damage to, or delay in the carriage of, such shipments.


RATE APPLICATION AND ADDITIONAL CHARGES


1. RATE APPLICATION

CE Beaufort's rates, as specified in its rate sheets, shall apply to all prepaid Bills of Lading originating from, or collect Bills of Lading destined to, the specified location(s). CE Beaufort reserves the right to make additions or deletions to the specified locations at any time without notice to the customer.


2. DECLARED VALUE CHARGES

(For CE Beaufort Liability Purposes).
No surcharge is applied to shipments (excluding Same Day) with a declared value (for CE Beaufort liability purposes) of up to $100.00. A charge of 3.25% of the declared value (for CE Beaufort liability purposes) in excess of $100.00 shall be applied. A surcharge of 3% of the declared value (for CE Beaufort liability purposes) will be applied to Same Day shipments.


3. SALES TAXES AND DUTIES

The customer shall pay to CE Beaufort any and all goods and services taxes (or any other similar taxes imposed with respect to the services provided, whether characterized as goods and services tax, sales tax, value added tax, business transfer tax or otherwise) (hereinafter referred to as "Sales Taxes") so that CE Beaufort is fully reimbursed by the customer as required by law. In addition to Sales Taxes, the customer shall pay to CE Beaufort any and all possible surcharges, customs and duties assessments (hereinafter referred to as "Duties") related to shipments tendered to CE Beaufort by the customer.


4. REWEIGH

CE Beaufort reserves the right to reweigh shipments, notwithstanding that a weight has been declared on the Bill of Lading. Reweighing is done on government approved scales. CE Beaufort does not reweigh any of its Packages and/ or envelopes. In the event customer fails to declare a weight on the Bill of Lading and CE Beaufort does not reweigh the shipment, CE Beaufort reserves the right to ascribe to any such shipment an average shipment weight. The customer acknowledges that charges based on the weight determined or ascribed by CE Beaufort shall be levied and agrees to pay same


5. CUBING/LOW DENSITY SHIPMENTS


All charges are based on a minimum density of:

  • 15 lbs. per cubic foot for AIR (6.804 kgs per .0283 cubic metres)
  • 10 lbs. per cubic foot for GROUND (4.562 kgs per .0283 cubic metres)

Charges for low density shipments will be calculated at the appropriate density rate per cubic foot. The formula to be used in calculating the cubed weight of each package in the shipment is as follows:

6. DESTINATION CHARGES


(6.1) Beyond Charge. An additional charge will be applied where the destination point is deemed by CE Beaufort to be remote or is not serviced directly by CE Beaufort.
(6.2) Rural Charge. An additional charge will be applied where an area is deemed by CE Beaufort to be rural in nature.


7. ANCILLARY CHARGES


(7.1) Chain of Signature (COS) Charge. An additional charge will be applied when shipping controlled substances such as narcotics and firearms via CE Beaufort�s COS security service.
(7.2) Special Handling Charges An additional charge will be applied when shipping items which require special handling including, without limitation:


(7.2.1) non-packaged (unboxed) items (excluding Packages and/ or, PuroPak and document shipments) - items not fully encased in a suitable shipping container (e.g. tires, pails, shrink wrapped items, etc.);
(7.2.2) overweight/oversized items - items which weigh more than 71 lbs and/or exceed 5 feet in length or a total overall package size of 165 inches (calculated as follows: length + 2 x width + 2 x height); and
(7.2.3) unsuitable items items which, due to their nature (size, shape, packaging, contents, e.g. ball bearings, nuts, bolts and fasteners, liquids, wooden or metal crates, etc.), CE Beaufort, in its sole discretion, deems not suitable for sorting and/or handling using CE Beaufort�s automated systems. The payment of Special Handling & Charges in respect of a particular shipment will in no way affect CE Beaufort's maximum liability for loss, damage, delay, failure to deliver or misdelivery of such shipment or the classification of a shipment as being "at shipper's risk".


(7.3) Dangerous Goods Charge. An additional charge will be applied when shipping Dangerous Goods as they require special handling procedures.
(7.4) After Hours Pick Up Charge. An additional charge will be applied where the request for pick up is received after standard order taking hours or the shipment is picked up after standard pick up times. 8. ADMINISTRATIVE CHARGES


(8.1) Address Correction Charge. An additional charge will be applied where the receiver�s address is incorrect, incomplete or not legible.
(8.2) Missing Account Number Charge. An additional charge will be applied where no account number appears or an incorrect account number is inserted on the Bill of Lading by the shipper.
(8.3) Collect/Third Party Charge. an additional charge will be applied when transportation charges are paid by the receiver or third party.
(8.4) Proof of Delivery Charge. CE Beaufort may provide electronic Proof of Delivery (POD), to customers at no charge. Electronic POD's may be obtained through CE Beaufort's website, www.CEBeaufort.com, from the following e-mail address: CE [email protected], through CE Beaufort's Automated Shipping Software, or verbally by contacting 1 905-301-9401. An additional charge will be applied when a copy of the actual route sheet, if available, is requested. If an electronic POD is not available, the customers will be provided with a copy of the route sheet, if available, free of charge.
(8.5) Fuel Surcharge. CE Beaufort reserves the right to apply, from time to time, a fuel surcharge on all AIR and GROUND shipments upon fifteen (15) days' prior notice. Any such fuel surcharge applied shall be applied to the sum of the following shipping charges: base shipping rate + additional weight charges + rural charges + beyond charges


9. PAYMENT GUARANTEE


The shipper agrees to pay CE Beaufort all shipping charges (including without limitation all Sales Taxes and Duties) in the event the receiver, on a collect shipment, or third party, on a third party billing shipment, refuses to pay CE Beaufort.

PACKAGE ACCEPTANCE POLICY


1. EXTERIOR PACKAGING


(1.1) Defect-Free Carton-A defect-free carton maintains the original rigidity of its corrugated sidewalls. The carton's corner seals and flaps must remain intact. Carton defects include punctures, tears, rips or corner damage, each of which reduces the carton's structural integrity.
(1.2) Defect-Free Carton Closure-Masking or cellophane tapes will not supply the strength necessary to secure packages traveling through CE Beaufort's distribution system. The minimum acceptable tape is two inches wide for pressure-sensitive plastic tape, and three inches wide for water-activated or reinforced paper tape. String or rope is prohibited, as is the use of gift wrap on the exterior of any package.
(1.3) Strength of Carton-The strength of the corrugated carton is a critical factor in a package's ability to withstand the normal shipping trauma of handling and transportation. The carton's class stamp, printed on the bottom of the carton, designates the maximum allowable content weight and is shown as the last number at the bottom of the stamp. Cans and pails: Lid clips must be used on all sizes of paint cans. Locking lids must be used on all sizes of pails.


2. INTERIOR PACKAGING

The contents of a package must be held firmly in place by the interior (internal) packaging system. Interior packaging must protect carton contents from normal external forces such as the pressure exerted by the stacking of other packages on top of it. Sufficient internal packaging is especially important for light, fragile packages


3. SIZE LIMITATIONS


(3.1) AIR Maximum Length - 96 inches (2.4 metres)
(3.2) GROUND Maximum Length - 120 inches (3.0 metres)
(3.3) AIR/ GROUND Overall Size

  • AIR 144 inches (3.7 metres

4. NON-PACKAGED GOODS


Non-packaged goods are subject to Special Handling Charges and are only accepted for shipping once CE Beaufort is assured that they pose no hazard to CE Beaufort staff and equipment and to other packages


5. PROPER LABELLING


Each package or piece must display a CE Beaufort, or CE Beaufort approved, Bar Coded Parcel Identification Number (P.I.N.) and a properly secured and completed address label, as follows:


(5.1) The address label(s) display(s) theshipper's and receiver's full address including postal code and phone number including area code (post office box addresses are not permitted). In addition to the above information, the Bill of Lading must contain:
          - Customer account number - Service option selected - Billing instructions - Number of pieces - Weight of shipment - Declared value (for CE Beaufort liability purposes) - optional - Date and signature
(5.2) The address label must be securely fastened to the top of each package or piece. String or wire tags are not acceptable, as they are prone to being pulled off. Improper labelling may result in the shipment being subsequently delayed or lost. It is strongly recommended that a duplicate label be attached to an inner flap of each package or piece.
(5.3) All previous delivery address labels and markings must be covered or removed.
(5.4) A shipment consisting of more than one package or piece must have each package or piece individually numbered. If a shipment consists of three packages, for example, the packages would be marked as being 1 of 3, 2 of 3 and 3 of 3. This numbering of packages is in addition to the requirement that each package or piece of the shipment displays a unique P.I.N. and full delivery address.
(5.5) Orientation "up" arrows must be located on either both sides or ends of each package containing liquids or fragile items.
(5.6) Liquid packs must be labelled "SPILLABLE". Glass or ceramic products must be labelled "GLASS".


NOTE: Rural route numbers (RR#s) are not acceptable in the CE Beaufort distribution system unless the receiver's full phone number is clearly marked on all shipment packages or pieces and the Bill of Lading. For US and other international shipments that consist of more than one package or piece, the main Bill of Lading number must be clearly written on each additional package or piece (because such shipments are tracked by a single P.I.N. once outside of Canada).


6. CUSTOMER WARRANTY


The customer warrants that the shipment will be properly described on the face of the Bill of Lading and any accompanying documentation. The customer further warrants that the shipment:


(6.1) will be acceptable for transport;
(6.2) will not consist of "Prohibited Shipments" (see Shipment and Packaging);
(6.3) will comply with CE Beaufort's "Shipping Restrictions" (see Shipment and Packaging); and
(6.4) will be properly marked, addressed and packaged to ensure safe transportation in accordance with CE Beaufort's ordinary care in handling and in accordance with all applicable legislation, including without limitation, the Transportation of Dangerous Goods Act and the Regulations thereto, the ICAO Technical Instructions and the IATA Regulations.

1. SAME DAY SERVICE OPTIONS:


(1.1) NEXT FLIGHT OUT is available for deliveries across Canada, or from Canada to the US. Customers' shipments will be picked up, taken to the nearest major airport and placed on the next available flight out. Upon landing, customers' shipments will be delivered directly to their destinations.
(1.2) DIRECT DRIVE service is a point to point direct delivery service available within Canada. Customers' packages will be collected from their pick up locations and driven directly to their destinations.
(1.3) ON AND GONE ®, HOT, RUSH and REGULAR services are direct delivery in-city messenger services available in certain cities within Canada. Depending on the pick up location and destination, CE Beaufort may pick up and deliver customers' shipments in the same city within 30 minutes to 5 hours of the call for delivery, depending on the service requested.

SAME DAY TERMS AND CONDITIONS:


(i) A Same Day Bill of Lading must be completed by or on behalf of the customer/shipper.
(ii) Dangerous Goods and COS shipments will not be accepted as Same Day deliveries.
(iii) Limitation of Liability - (As per Terms and Conditions herein).
(iv) Same Day service options are not money back guaranteed services.


2. CHEQUE/ CASH PAYMENTS TERMS AND CONDITIONS:


(2.1) CE Beaufort agrees to collect a cheque, post-dated cheque, certified cheque, bank draft or money order made payable to the sender in the amount noted on the face of the Cheque/ Cash Payments prior to releasing the shipment to the receiver.
(2.2) CE Beaufort's liability in the event of loss of, or damage, or delay in the delivery of the Cheque/ Cash Payments envelope, regardless of the manner in which that loss, damage or delay occurs, or for failure to collect a cheque, postdated cheque, certified cheque, bank draft or money order at delivery, or if the amount noted on any of the above is incorrect, is limited to a refund of the freight charges paid for the Cheque/ Cash Payments shipment.
(2.3) CE Beaufort assumes no responsibility for ensuring the genuineness of a document purporting to be a cheque, post-dated cheque, certified cheque, bank draft or money order, and assumes no liability in the event that the document received by CE Beaufort is not that which it was represented to be by the receiver.
(2.4) CE Beaufort makes no representation regarding the validity of the cheque, post-dated cheque, certified cheque, bank draft or money order received and assumes no liability in the event that the cheque, post-dated cheque, certified cheque, bank draft or money order is not honoured.
(2.5) CE Beaufort assumes no responsibility for ensuring that the receiver complies with the form of payment requested by the sender and assumes no liability in respect thereof.
(2.6) The sender is required to advise the receiver of the amount of the cheque, post-dated cheque, certified cheque, bank draft or money order required prior to delivery by CE Beaufort, any of which must be made payable to the sender, and any of which are accepted at sender's risk.
(2.7) If the receiver refuses to accept delivery of the shipment, for whatever reason, the sender will be billed and agrees to pay the shipping costs for the return of the shipment.
(2.8) Only cheques, post-dated cheques, certified cheques, bank drafts or money orders are acceptable. Cash is prohibited.
(2.9) These Cheque/ Cash Payments terms and conditions are non-negotiable and cannot be altered, varied or amended.
